Welcome to LuxeCelsior Wine App. By accessing or using our App, you agree to be bound by these Terms of Service ("Terms"). Please read them carefully before using the App.

1. Acceptance of Terms

By accessing or using the LuxeCelsior Wine App (the "App"), you agree to comply with and be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using or accessing this App.

2. Use of the App

You agree to use the App only for lawful purposes. You are prohibited from:

• Using the App in any way that violates applicable local, national, or international laws or regulations.
• Transmitting any unsolicited or unauthorized advertising or promotional material.
• Impersonating any person or entity or misrepresenting your affiliation with a person or entity.
• Engaging in any conduct that restricts or inhibits anyone's use or enjoyment of the App.

3. User Accounts

To access certain features of the App, you may be required to create an account. You are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer or device. You agree to accept responsibility for all activities that occur under your account.

4. Wine Marketplace

The App includes a wine marketplace where users can buy and sell wines. By participating in the Marketplace, you agree to the following: Sellers and Buyers must practice good code of conduct. Sellers must provide accurate product listings and accurate corresponding photos. As a Seller, you must promptly accept the order and immediately label it as "Sold". The following terms must be agreed upon and accepted by both the Buyer and the Seller before the product is shipped.

• a. Payments

  Seller must notify Buyer of accepted payment methods, taxes, and currency. Buyer agrees to provide accurate payment information.

• b. Shipping

  Sellers are responsible for shipping wines in compliance with all applicable laws and regulations. Buyers are responsible for ensuring they can legally receive wine shipments in their location. Sellers must notify Buyer of shipping cost and fees, carriers, delivery window, and geographic limits.

• c. Returns and Refunds

  All sales are final unless the wine is damaged or not as described. In such cases, please contact the seller immediately and copy us if need be at [email protected] within 7 days of receipt. Note: Sellers and Buyers can create their own terms of sale in the Marketplace.

5. Intellectual Property

The App and its original content, features, and functionality are owned by LuxeCelsior and are protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

6. Disclaimer of Warranties

The App is provided on an "as is" and "as available" basis without any warranties of any kind, either express or implied. LuxeCelsior does not warrant that the App will be uninterrupted, error-free, or free of viruses or other harmful components.

7. Limitation of Liability

To the fullest extent permitted by law, LuxeCelsior shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of (or inability to access or use) the App.

8. Governing Law

These Terms shall be governed and construed in accordance with the laws of the State of New York, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in New York.

9. Changes to Terms

We reserve the right to modify or replace these Terms at any time. We will provide notice of any significant changes by updating the effective date at the top of this page. Your continued use of the App after any changes constitutes your acceptance of the new Terms.

10. Termination

We may terminate or suspend your account and access to the App immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the App will immediately cease.

11. Age Restriction

The App is intended for use by individuals who are of legal drinking age (21 years or older in the United States). By using the App, you confirm that you meet this age requirement. We reserve the right to terminate accounts of users found to be under the legal drinking age.
